Terms and Conditions

Effective date: 19 May 2026

These Terms and Conditions form a legally binding agreement between you and DEN MOBILE regarding your use of the DEN MOBILE platform, including the mobile application, web admin portal, APIs, dialer workflow, follow-up workflow, and related services.

Please read these terms carefully. By registering, logging in, using the app, using the web dashboard, or allowing any user to access your account, you agree to these Terms.

DEN MOBILE provides a cloud-based sales execution platform that may include:

3. Account and Authority

If you accept these Terms on behalf of a company, you represent that you have authority to bind that company. You must ensure all users under your account comply with these Terms.

4. Fees, Pricing, and Billing

Current published pricing is device-based and may be updated from time to time with prior notice on official channels.

Unless otherwise agreed, invoices are monthly and payable according to invoice terms. Non-payment may lead to suspension.

6. Acceptable Use and Telecom Compliance

You may not use DEN MOBILE for illegal, abusive, deceptive, or harmful communications. You are solely responsible for campaign content, destination numbers, and contact permissions.

7. Service Integrity and Security

Customer is responsible for all activity under its company account, including actions by admins, agents, and integrated systems. You must notify DEN MOBILE immediately if you suspect unauthorized access.

DEN MOBILE may suspend or terminate access, with or without prior notice where required for security or legal reasons, including for:

9. Data, Privacy, and Logs

DEN MOBILE processes account and operational data needed to run the Platform (for example login, queue, tagging, delivery, and audit logs). Privacy handling is governed by the Privacy Policy in addition to these Terms.

10. Third-Party Dependencies

Some functions rely on mobile OS behavior, telecom networks, WhatsApp availability, device settings, and other third-party systems. DEN MOBILE is not liable for outages or restrictions caused by third-party providers or device vendors.

11. Intellectual Property

DEN MOBILE and its software, interfaces, logic, and branding are proprietary. Except for the limited right to use the Services during subscription, no ownership is transferred to Customer.

12. Disclaimer of Warranties

Services are provided on an "as is" and "as available" basis. DEN MOBILE does not guarantee uninterrupted operation, error-free service, or suitability for every specific business case.

13. Limitation of Liability

To the maximum extent permitted by law, DEN MOBILE is not liable for indirect, consequential, special, or punitive losses, including loss of revenue, data, or business opportunity.

Aggregate liability for direct claims arising from the Services is limited to the total amount paid by Customer for the three (3) months immediately before the event giving rise to the claim.

Customer agrees to indemnify and hold DEN MOBILE harmless against claims, penalties, or costs resulting from Customer's unlawful use, data misuse, unauthorized calling, or breach of these Terms.

15. Changes to Terms

DEN MOBILE may update these Terms to reflect product, legal, or operational changes. The latest version published on this page applies from its effective date. Continued use after updates constitutes acceptance.

16. Governing Law

These Terms are governed by applicable laws of Malaysia unless otherwise agreed in writing. Parties will first attempt good-faith resolution before commencing formal proceedings.
